The PROCEDE program is a legal process that gives ejido members the means to convert ejido land into private property, which can be sold and transferred to non-ejido members, including foreigners.
For the simple fact that very few foreign investors have a trust worthy friends living in an ejido community that could act as a prestanombre, the PROCEDE program usually provides foreigners buyers the safest option.
In 1992, the government of Mexico introduced a number of privatization polices aimed at developing rural Mexico. The biggest change was the amendment to Article 27 of the Mexican Constitution, which established a new agrarian code of law. These reforms ended the governments obligation to provide farm land to peasants, and gave ejido members additional rights to ejido land, and a means to convert ejido land to private property through the PROCEDE program.
The PROCEDE program is not automatic, and each individual ejido community must initiate its own petition to the government before the process begins.
